That isn't stealing. They were thrown away. He just walked into someone's home without permission. That's illegal.

Yes, indeed, breaking and entering is illegal, a felony in most places. If people are inside when the B&E happens then the crime is more serious, Burglary of an Occupied Residence or Business. B&E does not require proof that a lock was broken in most places. so long as the defendant lacked permission to enter the premises.
