A couple mentions of crimes involving diapers. I know there have been more. I'm not posting this video to judge anyone, but rather as a cautionary message. It's not always easy for certain folks (myself included) to express their sexuality in a healthy manner, but it is something that we must master on our path to becoming an enlightened species.

From the news article: "Barton Bagnes, dubbed "Diaper Boy" by police, was sent to prison in 2010 for wearing an Elmo diaper and exposing it to two 9-year-old girls. The Utah Supreme Court overturned his convictions Friday, saying they were "unusual" but not criminal."

Things like this are why vanillas may associate ABDLs with pedophelia.

Hey , I am a 70 1/2 year old gruff biker , live life my way ! And it came to pass , mid 2018 , that just out of the blue , I started to just have problems , getting to the toilet , for both #1 and #2, and my wife , just took it upon herself  , to just go out and buy me a case of attends adult diapers , and just put me in them , every day , or right after I woke up and tried to get out of bed ! But , I was , so , not that guy to just piss and shit , my diaper like some , sick fuck ! I mean all I talked about was , I was going to just step out into traffic, or do myself , as I just couldn’t live like this ! But , my wife was very patient, and loving , as she just took my pooped wet diaper off , and I just got in the shower, and I could clean myself off real good in less than 8-10 minutes ! But still I just bitched , and complained , but after just about 4 months , I just found that , hey , this wearing and using diapers thing isn’t the end of the world , and I can do just about everything , I did before , all I had to do was just get into the right mind set , and it was very different at first , I mean , like I am walking in the mall , and next thing I know, I’m just pooping myself , and after a short while , I was just kool with it , and I did the same when I could feel my diaper just getting , very warm and wet , and here , I’m out in the grocery store , getting stuff , for dinner , and my diaper is wet warm and pooped , and I sorta liked it  ! So today , I feel the same , I don’t mind being wet or messy , and the plastic pants mask most of the smell ! But today I had found these pills , Devrom , that not only make my stools a dark brown , but take all the stink outta my dirty diaper , but I still have to worry about the sounds , like the squelching , and  snapping , and popping as a large bm just slides out , tents the back of my diaper the jus collapses , in on itself , and make this , huge bulge in the center of my butt , and I just don’t pay it no mind , and never has anybody ever so much as looked at me funny , and just on the start of , December , I found these pills , “Devrom” , I take 3 I. The morning and 3 before, bed , and just like magic , my big mess , doesn’t have any stink ! So now I can do things I thought were impossible, and nobody can smell , any thing , unless it’s making those loud , squelching , and poppin sounds , doing it in my diaper is sometimes very noisy and that , just drawls attention , but still , I  can do other thing that don’t drawl to much attention and I have never been , even so much as looked at funny , as I just walk by , with this grapefruit size bulge in the middle I of my butt ! But not ever has a soul , ever looked at me, funny , and since I started , taking these Devrom , pills that just eliminate all , that poopy , stink , so what’s not to like ? 😁

Look up Mark Redwine. His kids found photos of him eating poo out of a diaper. When his 13 year old son brought it up during an argument, he killed his own kid.

Except that as distasteful as you find it, it isn't against the law.    Lewdness generally requires showing the private parts or performing or simulation a sexual act or masturbation.    Showing off your underwear doesn't quite fall under the statute.

If exposing your underwear to children was against the law, a lot of people would be in jail.

 

They should have been charged with "public nuisance" or some such, which would have stood.

Over the last couple of decades, I have lent encouragement to quite a few men and women who have gradually become incontinent in middle and old age.  As someone who has been incontinent since birth, in the beginning I point out that this is not a disability unless you choose to let it take over your life.  To the contrary, it is basically a "clean up in aisle 5" kind of experience.  It takes time for the initial sense of embarrassment to fade away, but as incontinent individuals become more confident that they can manage this problem without too much upset to their daily routine, and they realize that no one who crosses their paths is paying any attention, it does go away.  I have yet to counsel anyone who needed more than seven months to have their self-confidence fully restored.

One thing I would suggest to you is that you give some thought to your diet, and especially your fiber intake.  What you eat determines the firmness of your stool, as well as its odor.  Activated charcoal will neutralize the odor, but the right diet should take care of the problem naturally.

As distasteful as it is, I guess it doesn't fit the definition of lewd conduct. 

I suspect that my knowledge of Utah law isn't quite to the same level as the Utah Supreme Court, so I'll leave it to other Utah judges to make those sort of judgements.  AFAIK, nobody on this board is a Utah judge, so maybe we should temper our judgment on whether the conviction should have stood to questioning rather than declaring.  It's called the Dunning-Kruger Effect when somebody with limited knowledge thinks they understand an idea better than the experts.

It took 15 years to overturn the conviction, so it's safe to say that it required a lot of debate. It wasn't a clear decision.  It doesn't say whether he spent the entire 15 years in prison, but if he did- I think that's excessive.   Not that I condone what he did, but 15 years in prison for that kind of conduct is excessive. I think spending 15 years dealing with this case counts as time served, regardless of whether the conviction was overturned or not.

With that being said, the guy needs help!

The article does a good job of laying out the Court's thinking-- and this was a unanimous verdict.  He was convicted for a second degree felony, and sentenced to a max of 15 years.  He was also convicted of 2 counts for a third degree felony, with time to be served concurrently.  Note that. as the article makes clear, displaying his diaper was the third degree felony; it was walking up to two girls and handing them a flyer showing children in diapers that was the more serious charge.

What the article does not point out is that the events in question occurred after the kidnapping of Elizabeth Smart in SLC.  That case was in the public eye for years, and it definitely influenced the legal environment in Utah.

I didn't realize that connection, and the concurrent sentence seemed harsh.  I don't recall seeing what sentence he served.  The conviction was in 2010, so I can't imagine he was still in prison when his conviction was overturned.  His sentence compared to Brock Turner's shows that one's social status plays a huge role in how justice is doled out in the USA.

He served 5 years (released 2014).  You can read the Court's opinion in full: State of Utah v. Barton Jason Bagnes, 2014 UT 4 (UT Sup Ct., 2-14-2014).  Much turned on the failure of the statute to define lewdness (13), which led the court to work out a definition to its own satisfaction, which it then used as a basis for overturning the conviction (24).  I would also encourage readers of the opinion to compare (4-5) at the outset with (44) at the end.

It should be noted that the defendant had been convicted 10 years earlier under this same statute-- the only one of 14 previous police reports filed against him to be pursued at law.  He underwent psychiatric examination prior to trial in 2009, and the findings from that evaluation factored heavily into his sentencing.  It appears, in short, that the presiding District Court judge was determined to get a dangerous individual off the streets.

In sum, as someone who engaged the law in both the classroom and the courtroom, I agree that the statute is poorly worded, while I would describe the Court's reasoning as "creative."  Unfortunately, the one invites the other, and the whole is commonplace.

To be honest, I get that.  To me, purposely exposing a diaper in public is taboo.  Doing it in front of children?   Yeah!  Red FLAG! I don't think he belongs unsupervised in public.

However, some people did far worse to children, and the Catholic church moved them to other parishes so they could traumatize other children.
