lilme`
So about 2 years ago, NY state legalized gay marriage and my partner and I tied the knot. We went into H&R block really excited to file jointly, only to discover that while we could file jointly for NY, the federal didn't see it that way. We still had to file separately for them. DailyDi
Should change soon in light of the recent SCOTUS rulings. IRS is slow to change. Link to comment
ForbiddenFruit
Yeah, the DOMA ruling has it so that you won't be penalised for correctly stating you are married on your fed taxes. Link to comment
Bettypooh
This is not over- SCOTUS simply lacks the guts to take on something this controversial even though that is their job Within a few years their screwy ruling is going to bite them in the butt as a legally-married couple crosses state lines and demands equal recognition there, which may manisest itself as a tax issue. We made progress but we still haven't reached the goal of total fairness yet Link to comment
bwiannewick
The IRS has just released a report stating that those of us "married" in states that recognize gay marriage or in countries that allow same sex partners to be married, can and SHOULD file joint tax in the US. As well, the social security administration will only pay your benefits on death to your partner IF you are married in a state that fully recognizes same sex marriage OR any country. The easiest way to meet this requirement is to simply travel the country on your next vacation and get married in EVERY STATE that recognizes the marriage. As well, if you would like, visit the falls from the Canadian side on your Canadian honeymoon. We marry same sex partners from around the world every day her in Canada. The tax laws have now changed, you are free to move about your life. B Link to comment
